How Does Bankruptcy Impact Divorce?

You can file for bankruptcy during or before your divorce is final, but it is generally preferable to wait until after divorce proceedings or at least very near to the entry of final divorce orders. In any case, it is critical that your divorce lawyer understand the correct knowledge that should be used in property settlement orders to protect both parties during divorce and bankruptcy.

Financial obligations agreed to in the divorce settlement are not dischargeable in a bankruptcy proceeding. If you agree to take on a certain credit card debt during your divorce, you will not be able to include it in your bankruptcy. You will still be responsible for paying it. Therefore, you need to exercise great caution when agreeing to take on a martial debt.

While bankruptcy should be the last resort in any situation, it can allow divorcing parties the means to restructure their lives and build a solid foundation for their future.
